(1) You can just continue to call, nag, email, and send letters until he caves in or (2) find him and kick his A** but that will not solve anything either.......(might make you feel better) but won't solve anything! When you file your claim, sue not only for the money back, but for fraud, which will net you more than what you came spent on the bad ipod and the filing fee. If you executed the transaction via mail, you are in beter shape. If you picked it up and paid him without testing it, it is buyer beware and you will likely not recover your money.
